Terms of service

These terms govern your use of ncpsinfosec.com. They are not the agreement under which we deliver security services — that is the master services agreement (MSA) executed between NCPS Information Security, Inc. and the client organisation. Where the two conflict for a client, the MSA controls.

1. Acceptance

By accessing this website you agree to these terms. If you do not agree, please do not use the site.

2. Informational purpose

Content on this site is general information about our services. It is not security, legal, accounting, or regulatory advice, and it does not create a client relationship. Do not act on it in respect of your own environment without an engagement or independent advice.

3. Pricing information

Prices published on this site are list prices for standard scopes in United States dollars, exclusive of applicable taxes, and are indicative rather than an offer. Binding pricing is the pricing set out in a written quote or order form signed by both parties. We may change list prices at any time; a signed quote is honoured for 30 days from issue, and contracted rates are governed by the price-protection terms in the MSA.

4. Service level commitments

Service levels described on this site summarise the commitments available in our agreements. The measurement methodology, exclusions, remedies, and claim procedure are set out in full in the service-level schedule attached to the MSA. Summaries here do not create standalone contractual obligations.

5. Customer statements and outcomes

Reviews, testimonials, case studies, and metrics on this site describe outcomes experienced by particular organisations in particular circumstances. They are not a guarantee, warranty, or prediction of the results you will obtain. No security service can guarantee prevention of every compromise.

6. Acceptable use

You agree not to: attempt to gain unauthorised access to this site or any connected system; probe, scan, or test the vulnerability of our infrastructure without our prior written authorisation; interfere with service to any user; scrape the site by automated means beyond ordinary search-engine indexing; or use our marks or content to imply an affiliation that does not exist.

7. Coordinated disclosure

If you believe you have found a security vulnerability in this website or our infrastructure, please tell us at security@ncpsinfosec.com. We acknowledge reports within two business days and will not pursue legal action against researchers who act in good faith, avoid privacy violations and service degradation, and give us reasonable time to remediate before disclosure.

8. Intellectual property

The site, its content, layout, and the NCPS InfoSec name, logo, and marks are owned by NCPS Information Security, Inc. or its licensors. You may quote short excerpts with attribution and a link. All other reproduction requires written permission.

9. Third-party links

Links to third-party sites are provided for convenience. We do not control and are not responsible for their content, security, or privacy practices.

10. Disclaimer

The site is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the site will be uninterrupted, error-free, or that its content is complete or current.

11. Limitation of liability

To the fullest extent permitted by law, NCPS Information Security, Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of this website. Our aggregate liability arising from the website will not exceed one hundred United States dollars ($100). Liability arising from contracted services is governed exclusively by the MSA.

12. Indemnity

You agree to indemnify NCPS Information Security, Inc. against claims arising from your breach of these terms or your misuse of the site.

13. Governing law and venue

These terms are governed by the laws of the State of Delaware without regard to conflict-of-laws principles. The state and federal courts located in New Castle County, Delaware have exclusive jurisdiction, and both parties consent to that venue.

14. Changes

We may revise these terms at any time by posting an updated version with a new date. Continued use of the site after a change constitutes acceptance.
